ABSTRACT


The main objective of this thesis is to find some jurisprudence in accordance with the opinion of the problems of research themes and contributes in the fields of research and research without any scientific degree or scientific level rise. Because it is a characteristic of ignorance and it is not the characteristic of science.                                                             

With this, has completed research on the theme of child adoption laws according to some schools of jurisprudence by using the method of comparative analysis. Gathering the opinions of jurisprudence belonged to some schools of their books by stating the proposition of such opinion.                                                                                                               

The schools are schools that have been recognized by the entire people of Islam that exist in all corners of the world. Namely: four schools recognized by the AhluSunnah, Shia, dhohiriyah and ibadhiyah  .                                                                                                

The theme of this study aims to determine some of the opinions of jurists in the schools of the three main problems that urgent in the case of children adoption. Who is the person that becoming a substitute (mother) of the child after adoption. The effect of mother's wedding adopters at the time of adoption and also displacement of children that are adopted  .

This research is the answer of some question, those are; 1.) How the procedure for change of parents in the process of adoption by the various schools of jurisprudence? 2.) What is the effect of mother's wedding adopters, to the child adoption when the adoption period? 3.) Is it permited the adoption of either of the husband or wife to bring adopted children move to another country?                                                                                      

To realize the goals of this research and obtain some research results that is giving beneficial for us in the present. Researchers using comparative analysis method, it was used in order to get a clear and comprehensive answer of research questions that brought us to the conclusive result that is appropriate from the following steps: 1. limit the problem of fiqh, and clarify the position of the jurists on the issue. 2. Looking at some of the opinions of jurists on this matter, summarized in the opinions that exist in schools of fiqh that is appropriate with the time of such schools, starting from the previous schools. 3. Convey the arguments of any opinion that is composed of the first order, starting from the Quran, then the Hadith. 4. Explanation of differ}
