ABSTRACT

In the election of couples before marriage, it is not only required readiness, but also needed to get harmony in the household. In Islam, one of the factors that become consideration in order to realize the harmonization in marriage is kafa'ah. In Islam, kafa'ah is identified with similarities in some respects, such as religion, wealth, heredity, profession, and etc. Even in certain community, such as pesantren family, for example, kafa'ah becomes a very urgent thing to be considered. It is different with the Pesantren Salafiyah Pasuruan family. In the pre-research of this study, researcher founded the phenomenon that the family of pesantren Salafiyah Pasuruan that takes important the kafa'ah factor. So researcher founded pesantren family who do not marry the sons or daughters in the consideration of kafa'ah, especially kafa'ah in the classical fiqh rules. In fact, this pesantren family is known to hold the rules of a strong classical fiqh.

This research aims at determining the criteria and implementation of kafa'ah of pesantren Salafiyah family. Means this study aims at seeing kafa'ah in the realm of idealism and reality of Pesantren Salafiyah Pasuruan family. This type of research used field research type (field research), with qualitative approach. Data collection method was through observation and interview.

From the research that was conducted by researcher, it could be concluded that kafa'ah of marriage in pesantren Salafiyah family is entirely on the right of Wali. So the criterion of each wali is different. However, it can be concluded that the criteria of kafa'ah include on; First, kafa'ah based on religious factors, Second, kafa'ah based on communication intelligence factor, Third, kafa'ah based on education or knowledge. In the praxis, kafa'ah in the pesantren Salafiyah families are two kinds, First, the application of kafa'ah based on education or science, Second, the application of kafa'ah based on individual personality. From these results it was known that kafa'ah is actually a dynamic thing and can change in standardization in accordance with the times, environment and circumstances

ABSTRAK

Dalam pemilihan pasangan sebelum pernikahan, tidak hanya dibutuhkan kesiapan, akan tetapi juga diperlukan keserasian untuk mewujudkan keharmonisan dalam rumah tangga. Dalam Islam sendiri, salah satu faktor yang menjadi pertimbangan guna mewujudkan harmonisasi dalam perkawinan sebelum melangsungkannya adalah kafa?ah. Dalam Islam, kafa?ah diidentikkan dengan kesamaan dalam beberapa hal, seperti agama, kekayaan, keturunan, profesi, dan sebagainya. Bahkan dalam satu komunitas tertentu, seperti keluarga pesantren misalnya, kafa?ah menjadi hal yang sangat urgent untuk dipertimbangkan. Namun, berbeda halnya dengan keluarga pesantren Salafiyah Pasuruan. Dalam pra-riset penelitian ini, peneliti menemukan fenomena bahwa keluarga pesantren Salafiyah Pasuruan nyatanya tidak begitu mengedepankan faktor kafa?ah. Sehingga banyak peneliti jumpai dari keluarga pesantren yang tidak menikahkan putra maupun putrinya dengan pertimbangan kafa?ah, utamanya kafa?ah dalam aturan fiqh klasik. Padahal, keluarga pesantren ini dikenal memegangi aturan-aturan fiqh klasik yang kuat.
