ABSTRACT

Neglecting children often occurs in Indonesia for various reasons. An innocent child must bear his life from the age of the toddler. These unfortunate children need certainty in their lives both for the social legal status and for the religion status. Especially for girl, she must have a clear legal status for her nasab and her guardian if she gets married. The reality that happened in the community of neglected child in East Loloan Village has different system in solving the case. They involve all parties to solve it. 

This study aims to explain and understand the process of recognition and adoption of the neglected children in East Loloan Jembranan District based on sociological perspective and can explain and understand the status of adopting neglected child in fiqh and Government Regulation Number 54 of 2007 perspectives. Type of this research is field research and qualitative approach. The method of data collection is interview as a primary data. While the secondary data used literature reviews related to the focus of research. Data that has been collected and then processed and analyzed in accordance with the stages of research. 

The results of research conducted by researcher are: 1) the process of recognition and adoption of children sociologically use the system of kinship or kinship by through several processes, namely: First, the neglected child entitled to be cared for by people who find the first according to the criteria. Second, the recognition of children based on kinship and religion. Thirdly, testimony in the recognition and adoption of children is witnessed by environmental officials. Fourthly, the neglected children were adopted by breastfeeding the children to the parents who confessed and breastfed by the families of both parties. 2) the legal status of children findings in fiqh have differences according to the age, as follows: First, neglected child was found at infant age (0 months) legal status is returned to people who admit it both in nasab and guardian. Secondly, a child found over the age of 5 years, the legal status is returned to a parent who acknowledges it but for trust issues is returned to the judge's guardian if he / she is to marry off his / her child. The views of religious leaders on the legal status of children's findings perspective of PP. 54 of 2007 has the same legal certainty with adopted children. He/she became a foster child after obtaining legal provisions from the court

ABSTRAK

Pembuangan terhadap anak sering terjadi di Indonesia dengan berbagai alasan. Anak-anak yang tidak beruntung ini membutuhkan kepastian dalam hidupnya baik kepastian untuk negara maupun agama. Terutama pada anak perempuan, ia harus memiliki kejelasan status hukum untuk nasabnya dan walinya jika ia akan menikah. Realitas yang terjadi di masyarakat tetang penemuan anak di Kelurahan Loloan Timur memiliki sistem yang berbeda dalam menyelesaikan perkara.

Penelitian ini bertujuan untuk menjelaskan dan memahami proses pengakuan dan pengangkatan anak temuan di Kelurahan Loloan Timur Kecamatan Jembrana Kabupaten Jembrana Provinsi dan dapat menjelaskan dan memahami anak temuan perspektif fiqh dan Peraturan Pemerintah Nomor 54 Tahun 2007. Jenis penelitian ialah penelitian lapangan (field research) dan pendekatan kualitatif. Metode pengumpulan data ialah wawancara sebagai data primer. Sedangkan data sekunder menggunakan literatur yang berhubungan dengan fokus penelitian.
