ENGLISH:

An interesting phenomenon occurs in the community of Mojorejo Village of Junrejo of Batuwhere the public figures and religious figures are respected as highly respected, if there is a dispute within the households, the majority of community of Mojorejo Village still trust some community leaders and religious leaders as mediators in resolving the dispute. It is different with the general public who directly bringsthe lawsuit to the court about disputes in the household. the involvement of community leaders or religious leaders in non-litigation mediation in Mojorejo Village of Junrejo of Batu indicates that there are strategic social roles in the midst of community complexity. This is related to Structural Functionalism theory that had been initiated by Talcott Parsons.

There are two important things in the research: describing the mediation mechanism in resolving the divorce dispute in Mojorejo Village of Junrejo of Batu and analyzing the role of village "mediator" in resolving divorce dispute according to the structural functionalism theory of Talcott Parsons.

The type of research used empirical legal research. The approach used qualitative, while the type of data collection used interview, observation and documentation then classified and analyzed.

The research results indicated that: (1) The role of headman village and modinof Mojorejo village as village mediator are: inviting the community to resolve disputes that occur in the family in a non-litigation, resolving  divorce cases that are caused by economic factors, resolving the divorcecasesthat are caused by social factors (infidelity), resolving the divorce cases that are caused due to feud husband and wife, and many other problems outside the f divorce that can be resolved by public figures and also religious figures. (2) Structural Functionalism of the role of " mediator "in Mojorejo Village of Batu City, namely first: Adaptation. Adaptation process of headman and also modin of Mojorejo village as the "mediator" of the village, one of it is by socializing to the community to solve cases that occur in the household. The elements in the process of adaptation between components include: Adaptation of social culture, adaptation of ideology and political adaptation. Second, goal-attainment. The role of village "mediators" aims at resolving the cases that are caused by economic factors, reconciling the family disputes, resolving the cases in a non-litigation manner. Third, Integration. The formation of synergicity between community, community leaders and religious leaders of Mojorejo Village with the existing rules. Fourth, Latency. The realization of good social }
