ABSTRACT

The majority of each tribe in matters of marriage have different customs and cultures.  Similarly,  the  Lombok  society,  especially  Gapuk  village  where  the village society has customs that caused a phenomenon of married pocolin addition to thieves custom (stealing the bride). Married Pocol is done in a forced manner and can result in losses of either of the bride and groom, women or from the families of each bride and the biggest loss is felt that the good name in society will be smeared forever and for the perpetrators can culminate to divorce. In other words the disadvantages can occur in social, economic and educational aspects.

There are two important things in this research that is to understand the background occurs and the implementation of married pocol. then the view of Maqashid Shariah on the harmony of household perpetrators married pocol in the Gapuk village.

The type of research used in this study refers more to the type of field research. The approach used is qualitative, while the type of data collection used is by way of interviews, observations and documentation are further classified and analyzed.

The results of this study indicate that: (1) the background of the married pocol is that there are three kinds, first, the opposite relationship of the second improper type, in order to avoid free association and not violating the religious rules; and thirdly, the agreement of the characters (awiq-awiq) .Then the implementation of this married pocol is the same as withdrawing usually but in the initial process is different  and  divided  into  three  parts  as  well,  namely:  first,  agreement  or agreement  of  lovers,  second,  with  the  guardian  of  the  woman,  and  third, announced by jati selabar (messenger) that is by first notifying that there will be married. then after that the next day immediately held the marriage ceremony, then held a bejango (visiting the bride's house), and last held begawe (reception). (2) harmony in the household of the married pocol perpetrator in maqashid sharia perspective is divided into three levels: first, maqashid dharuriyyat: the perpetrator who  until  divorcethe  second,  maqashid  hajiyyat:  the  perpetrator  who  always quarrel or not to the divorce stage, and third, maqashid tahsiniyyat: harmonious perpetrator. Or it could be said that the phenomenon of harmony of married pocol is included in the category the mulghah advantage. (advantage that is against the syara 'or rejected by syara').

ABSTRAK

Mayoritas setiap suku dalam masalah perkawinan memiliki adat-istiadat dan budaya yang berbeda-beda. Begitu pula dengan masyarakat Lombok khusunya Desa Gapuk yang mana masyarakat desa ini mempunyai adat-istiadat yang mengakibatkan adanya fenomena merarik pocol yaitu selain adat maling (mencuri pengantin wanita). Merarik Pocol ini dilakukan secara terpaksa dan bisa mengakibatkan kerugian dari salah satu pihak baik calon pengantin laki-laki, perempuan maupun dari pihak keluarga masing-masing mempelai dan kerugian terbesar yang dirasakan yaitu nama baik di mayarakat akan tercoreng selamanya dan bagi para pelaku bisa berujung kepada perceraian. Dengan kata lain kerugiannya bisa terjadi dalam aspek sosial, ekonomi dan pendidikan.
