ABSTRACT

Xenotransplantation is a medication by transplanting organs from the donors in the form of animals to human beings that is new finding in the medical world. In this case, the experiment ever conducted by transplanting pig organs in the human body with fairly good results.

It has a significant impact on the various aspects of human life. The area that most affected is related to religion side especially Islam. In Islam, pig are animals that are categorized as the forbidden. That is why this medication becomes new polemic in the Islamic world.

There are many opinions among Ulama in solving this problem, many of them stated that the use of pigs is prohibited except in emergencies situation. And their opinion is limited to the use of pigs only for the medication. While the procedures for obtaining pig organs could not be explained in detail, but Ulama in general explain that everything related with forbidden goods for example pigs, then the law that was born of it is forbidden. So that the buying and selling pig organs included into the trading which is prohibited.

 This thesis present to provide some solutions to the polemic that occurred in the medical world. Particularly the procedures in terms of obtaining the pig organs by buying and selling. Furthermore, from the several opinions authors attempted to analyze and seek law determination method that is used by Ulama.

In this thesis the author uses analytic tool such as rules of ushul and fiqh in analyzing the opinion of Ulama. The final conclusions by the author is buying and selling pigs as a means of xenotransplantation is a norm to the times. Where this development has positive impact upon human survival, especially for those who have the disease in the internal organs thus requiring replacement organs. In Islam itself, as described in the rule of fiqh that one of the objectives of the Islamic sharia is keeping human life from the damage and destruction. So take advantage of pig organs, such as buying and selling as a transplantation that is urgent then the law is allowed. This is strengthened by a rule that stated "the law is changed according to whether or not the underlying reasons behind them.  

ABSTRAK

Xenotransplantasi, sebuah pengobatan dengan cara mentransplantasikan organ dari pendonor yang berupa hewan kepada seorang manusia adalah temuan baru dalam bidang kedokteran. Dalam hal ini pernah dilakukan sebuah percobaan dengan mentransplantasikan organ tubuh babi kepada tubuh manusia dengan hasil yang cukup baik. Namun dalam sisi lain hal ini bertentangan dengan syariah islamiyah yang mengharamkan babi. Oleh karenanya penulis berusaha untuk memberikan solusi terkait dengan problematika ini.

Adapun rumusan masalah dari penelitian ini terdiri dari dua hal, 1. Bagaimanakah pendapat ulama? madzhahib arba?ah mengenai hukum xenotransplantasi, dan jual beli babi sebagai perantaranya?, 2. Bagaiamanakah perbandingan pendapat yang dilakukan oleh ulama? kontemporer dalam penggalihan hukum terhadap jual beli babi sebagai alat xenotransplantasi dengan merujuk pada pendapat ulama? madzahib arba?ah?.

Maka atas rumusan masalah di atas, tujuan dari penelitian ini adalah 1. Mengetahui pendapat ulama? madzhahib arba?ah mengenai hukum xenotransplantasi, dan jual beli babi sebagai perantaranya.,}
