		abstract={INDONESIA:

Tujuan dari penelitian ini adalah untuk mendeskripsikan mengenai kendala terhadap praktek transportasi online di Kota Malang menurut tinjauan Peraturan Menteri Perhubungan Nomor 32 Tahun 2016 dan Hukum Islam. Penelitian ini disebut sebagai penelitian hukum empiris dengan menggunakan pendekatan yuridis sosiologis. Hasil penelitian ini menunjukan bahwa beberapa kendala yang terjadi terhadap adanya praktek transportasi online ini kini sudah teratasi dengan dikeluarkannya kebijakan baru yakni Permenhub Nomor 26 Tahun 2017 yang memberikan solusi sehingga tidak ada lagi permaslahan yang terjadi antara angkutan umum dan online. Dalam Hukum Islam sesuai dengan keberadaanya ia termasuk dalam maslahah mulghah atau maslahah yang ditolak karena adanya beberapa aturan yang diberlakukan oleh Dinas Perhubungan tidak ditaati oleh penyelenggara transportasi online, karena menurut mereka hal tersebut dianggap baik secara akal fikiran manusia namun tidak baik apalagi diperhatikan secara syara? atau dampaknya nanti seperti apa. Diharapkan bagi Dinas Perhubungan lebih tegas lagi memberikan arahan dan tindakan kepada penyelenggara transportasi online yang masih tidak mau menaati permenhub baru. Selain itu dengan diberlakukannya Permenhub baru ini diharapkan memberikan keadilan bagi transportasi online maupun angkutan umum sehingga tidak ada lagi aksi-aksi unjuk rasa atau kejadian lainnya.

The purpose of this research is to describe the obstacles to the practice of online in the city of Malang, according to the review of the Minister of Transportation Number 32 Year 2016 and today Islamic Law. Research is referred to as research the empirical facts by using the approach of the juridical sociological. The results showed that several obstacles that occur on the practice of online has now been resolved with the release of the new policy that is Permenhub Number 26 years 2017 to provide a solution so that no permaslahan's going on between public transport and online. In today Islamic Law according to its existence it is included in maslahah mulghah or maslahah that was rejected because there are some rules imposed by the Department of Transportation don't be adhered to by the organizers of online, because they think it is considered a good sense going on man, but don't let alone be considered syara ' or the impact like what. It is expected for the Department of Transportation is more strictly to stop giving directions and actions to the transportation that they still don't want to obey permenhub. n addition to central Permenhub is expected to provide justice for transportation online as well as public transport so that no acts of protest or the other.}
