ABSTRACT

Adopted child in society taking children from the Crater, the closest relatives of a husband or wife then the child put in a biological family, so the transition occurs and the responsibility of the biological parents to the adoptive parents to care for and raise a child. This Act in reality can be seen in the lives of several families on the tenggerese Muslims probolinggo Regency sukapura Subdistrict. The Division of the inheritance on the tenggerese also in share during the life of the elderly by means of grants and there is also after the death of muwarris. Adopted child in the tenggerese got heir and became a foster parent's heir. But in foster child only got 1/3 part course. 

Based on this, the researchers intend to examine related to: a). How did the tradition of division of inheritance to an adopted child in a tribal village Muslim Tenger Wonokerto districts Sukapura Probolinggo ? b). How reviews KHI and the Concept of Justice in inheritance adopted child in a Muslim village perched tribal traditions Wonokerto village Sukapura distric Probolinggo? , Researchers also reviewed from KHI and the concept of justice from it.

The steps that are ini use in this study. Include empirical research with Qualitative approach. The collecton of data that researchers are doing by way of iteview and observation. The data on the primary data by which to get in can be research directly. Data analysis was descriptive in nature which aim to describe a phenomenon that occurs in field. The latter is appealing a conclusion from such research.

Wonokerto village perched in the communities that foster child got the inheritance from adoptive parent because of the position of adopted children the same as biological children, so the foster child got the inheritance from adoptve parents. However, I foster child just got a will wajibah 1/3 parts, because the adopted child is not included in the bonds of marriage, offspring and wala?. 

ABSTRAK

Anak angkat dalam masyarakat Tengger adalah pengambilan anak dari kerabat terdekat dari seorang suami atau istri kemudian anak tersebut dimasukkan ke dalam keluarga kandung, sehingga terjadi peralihandan tanggung jawab dari orang tua kandung kepada orang tua angkat untuk merawat dan membesarkan anak tersebut. Perbuatan ini secara realita dapat dilihat dalam kehidupan beberapa keluarga pada Suku Tengger Muslim Kecamatan Sukapura Kabupaten Probolinggo. Pembagian waris di Suku Tengger juga di bagikan semasa hidup orang tua dengan cara hibah dan ada juga setelah wafatnya muwarris. Anak angkat dalam suku Tengger mendapat waris dan menjadi ahli waris orang tua angkat. Tetapi dalam Kompilasi Hukum Islam anak angkat hanya mendapat 1/3 bagian saja. Berdasarkan hal tersebut, peneliti bermaksud mengkaji yang berkaitan tentang: a). Bagaimana tradisi Pembagian harta waris kepada anak angkat dalam suku tenger muslim Desa Wonokerto Kecamatan Sukapura Kabupaten Probolinggo? b). Bagaimana tinjauan Kompilasi Hukum Islam dan Teori Keadilan dalam kewarisan anak angkat dalam tradisi Suku Tengger muslim Desa Wonokerto Kecamatan Sukapura Kabupaten Probolinggo? 

Langkah-langkah yang di gunakan dalam penelitian ini. Meliputi penelitian empiris dengan pendekatan kualitatif. Pengumpulan data yang peneliti lakukan dengan cara wawancara dan observasi. Data tersebut di dapatkan oleh data Primer yang di dapat peneli secara langsung. Analisis da}
