ABSTRACT

The background of this thesis is the impact of globalization which human needs are increasing and have to link to other countries in order to meet their needs, which becomes the basis of forming International trade. One of these International trade organizations is WTO (World Trade Organization). Indonesia is one of countries who participates treaty of WTO (World Trade Organization). Every countries who participates WTO must abide by rule and regulation of WTO ratification exists in UU No 7 of 1994, and reinforced with positive law in Indonesia; UU No 25 of 2007 about Capital Investment. WTO has the principle of non discrimination that one of them is national treatment principle. How the justice in Islamic perspective is due to Indonesia is a developing world that will compete with industrialized world.

This research uses normative research or called as book research. The approach that used in this research is concept approach. Therefore, the main study of this research is done with primary legal materials such as ratification UU No. 7 of 1994, UU No. 25 of 2007 about Capital Investment and Islamic law focus on maqosid syariah, secondary legal materials are literatures which is relevant with the title of thesis related to the principle of national treatment. The data collection used in this research is book study, therefore the method used in data analysis is editing, classifiying, verifying, analysing, and concluding.

In accordance with the result of the existing legal materials, the writer concludes that actually Indonesia had realized the principle of national treatment reinforced with UUPM No. 25 of 2007. The purpose of government is to protect domestic entrepreneur needs by appliying pattern of small and big trade partner. This strategy is used for facing the coming MEA.  Based on maqosid syariah, national treatment is less appropriate considering several problems in Rasulullah era. However, nowadays within the increasing of human needs, we should be selective to take advantage and avoid the negative effect. 

ABSTRAK

Skripsi ini dilatar belakangi dari Indonesia adalah negara pendiri WTO (world  Trade organization). Setiap negara WTO harus mengikuti aturan yang ada di dalamnya WTO. seperti yang terdapat dalam pasal 3 GATT tentang  prinsip non diskriminasi, salah satu dari prinsip non diskriminasi adalah prinsip national treatment. Indonesia meratifikasi  WTO yang terdapat pada Undang-Undang No 7 tahun 1994, dan diperkuat dalam hukum positif di Indonesia dalam UU No 25 Tahun 2007 Tentang Penanaman Modal. Apakah kebijakan peraturan perundang-undangan dibawah peraturan UU No 25 Tahun 2007 sudah mengimplementasikan  aturan prinsip national treatment. Bagaimanakah menurut Islam dalam keadilannya karena Indonesia adalah negara berkembang yang akan bersaing dengan negara-negara maju.

Dari latar belakang di atas dapat dirumuskan masalah sebagai berikut: 1)Bagaimanakah implikasi prinsip national treatment dalam UU No.25 Tahun 2007 terhadap kebijakan penanam modal di Indonesia. 2)Bagaimanakah prinsip national treatment  persepektif maqasid syariah. Dari ru}
