ABSTRACT

Copyright a moving objects intangible, so it can be as objects of fiduciary, but constitution no. 28 year 2014 about copyright and constitution no. 42 year 1999 about fiduciary insurance no organized a regulation clearly related its mechanisms, so the impact on its implementation in society. Islamic law regulate copyright-related provisions as the object of fiduciary in  National Fatwa Council Syari?ah  number 68/DSN-MUI/III 2008 about rahn tasjily.

This research aims to know the legal aspects of the object of copyright as a fiduciary related with the object, value, execution of copyright reviewed from constitution number 42 year 1999 about fiduciary insurance and to know Islamic views of copyright as an object of assurance contained in the National Fatwa Council Syari?ah number : 68/DSN-MUI/III/208 about rahn tasjily and Fiqhul Islam wa Adillatuhu Books written by Wahbah Az-Zuhaili. 

This research inclued normative law research with a conceptual approach, constitution approach, and comparative approach. While the data source used is ingredients primary law, secondary law, and tertiary law. The data collection  methods used by the study documents using content analysis.

And the research result indicate that copyright are as object fiduciary does not have clear regulations related to copyright any object that can be used as a fiduciary, which equires the principle of specialty constitution fiduciary fulfilled, and determining the value of copyright as an object of assurance required appraisal agencies, so the value of copyright when used as objects of fiduciary can be known with certainty, as well as the execution of copyright as a fiduciary guarantee object when the debtor injury appointments, is still difficult for the creditor to execute the object, because the copyright has the properties of moving objects intangible, which is not regulated clearly in copyright constitution and fiduciary constitution. Islamic law considers copyright part of in the form of a non material or benefits, so that copyrigth can be used as assurance with the object of the contract rahn tasjily, set out in the National Fatwa Council Syari?ah number : 68/DSN-MUI/III/208 about rahn tasjily, with the provisions of the assurance copyright object is the benefit of the economic rights of copyright.

ABSTRAK

Hak cipta merupakan benda bergerak tidak berwujud, sehingga dapat dijadikan sebagai objek jaminan fidusia. Undang-Undang Nomor 28 Tahun 2014 Tentang Hak cipta dan Undang-Undang Nomor 42 Tahun 1999 Tentang Jaminan Fidusia tidak mengatur regulasi yang jelas terkait mekanismenya, sehingga berdampak pada pelaksanaannya di masyarakat. Hukum Islam mengatur ketentuan terkait Hak cipta sebagai objek jaminan fidusia dalam Fatwa Dewan Syari?ah Nasional Nomor: 68/DSN-MUI/III 2008 Tentang Rahn Tasjily.

Penelitian ini bertujuan untuk mengetahui aspek hukum hak cipta sebagai objek jaminan fidusia yang berkaitan dengan objek, nilai, dan eksekusi terhadap hak cipta yang ditinjau dari UU No. 42 Tahun 1999 Tentang Jaminan Fidusia, dan untuk mengetahui pandangan Islam terhadap Hak Cipta sebagai objek jaminan yang termuat d}
