This research analyzes the action of farkhan who advertises baby at tokobagus.com site. His action arises anxiety in society and violate constitutional. the purpose of the research is to find out whether the deed of farkhan who post advertisement of baby`s sell and purchase can be prosecuted in criminal responsibility and the possible deed of the investigator polda metro jaya to farkhan as the peformer of baby`s sell and purchase advertisement at tokobagus.com site.



The writting of the legal memorandum uses analytical descriptive method. The method consists of learning and analyzing of valid terms in constitutional. The method aimed to describe systemically and factually based on postive law of criminal law in children trafficking. This writting uses yuridical normative approaching which is based on literature study or secondary data. 



The result of the research shows that the deed of farkhan who advertises baby at tokobagus.com fullfil constituent of article 83 section 23 at 2002 about children traficking. This can be determined as traficking action through online system. The investigator of Polda metro jaya is able to use print out of the baby`s advertisement at tokobagus.com site as the evidence based on constituent article 5 section 11 at 2008 about information and electronic transaction. The investigator also can use the print out of online news as the evidence. Therefore, using the evidence, the investigator can arrest farkhan.}
