@thesis{thesis, author={Dikkri Safaat}, title ={Legal Protection of Minor Children as Victims of Criminal Acts of Sexual Violence}, year={2022}, url={http://repository.undar.ac.id/id/eprint/2757/}, abstract={In Indonesia, cases of sexual violence have risen each year, victims are not only for adults, but now it has spread to adolescents, children and even young children. The phenomenon of sexual violence against children is increasingly common and has become globally in almost all countries. Cases of sexual violence against children continue to increase from time to time. The increase is not just in terms of volume or number of cases, but also in terms of quality. And what is even more tragic is that most of the perpetrators are from the family environment or the environment around the child, including in their own homes, schools, educational institutions, and the child's social environment. The results of the research and discussion show that criminal acts which include sexual crimes against children are raped, obscenity, and sexual exploitation. Indonesia already has a legal basis to provide protection for children who receive legal protection as outlined in Law Number 35 of 2014 concerning Child Protection for the amendment of Law Number 23 of 2022 concerning Child Protection. The crime of sexual violence is very worrying, especially if the victims are children who are still underage, because this will affect the psychological development of children, causing lifelong trauma and what is even more sad that children who are rape victims can become prostitutes. It's ruining their future. Sexual violence against children is one of the serious problems facing the government today because it is related to the government's efforts to implement the Child Protection Law No. 35 of 2014. In addition, children who are victims of sexual violence are part of a society whose development has not yet matured, either physically or psychologically. This requires special help. The criminal system in Indonesia has the right to restitution, the right to compensation given to the perpetrator against the victim of the crime of sexual violence against minors, the enforcement of castration that has not been enforced in Indonesia is a special design that must be enforced so that there is a deterrent effect for the perpetrators. In handling cases of violence against children, especially the crime of rape, law enforcement officers are still experiencing obstacles. In general, the obstacles faced are in the form of internal and external barriers.} }
