Tujuan penelitian ini adalah untuk mengetahui hak politik menurut Undang-Undang
Dasar Tahun 1945, mengetahui hak-hak politik warga Moro-Moro serta mengetahui
mekanisme penghilangan hak pilih dalam Pemilihan Umum Kepala Daerah
(Pemilukada). Metode penelitian yakni dengan menggunakan tipe penelitian yuridis
normatif dan pendekatan perundang-undangan (Statute Approach). Hasil penelitian
menunjukkan bahwa hak politik menurut UUD Tahun 1945 adalah hak setiap
orang/warga negara yang dapat dikurangi pemenuhannya (non derogable rights) serta
hak yang boleh dikurangi atau dibatasi (derogable rights). Hak politik warga MoroMoro yang bersifat absolut dan tidak boleh dikurangi pemenuhannya antara lain hak
atas perlakuan yang sama di depan hukum, hak atas status kewarganegaraan, hak atas
tempat tinggal di wilayah negaranya, hak memperoleh suaka politik dan hak bebas
dari perlakuan diskriminatif. Sedangkan hak yang boleh dikurangi diantaranya adalah
hak atas kebebasan berkumpul secara damai, hak atas kebebasan berserikat, hak atas
kebebasan menyatakan pendapat atau berekspresi melalui lisan maupun tulisan, dan
hak untuk memilih dan dipilih. Adapun penghilangan hak pilih warga negara dapat
dibenarkan dengan cara hukum.

Abstract
The purpose of this study was to determine the political rights under the Constitution
of 1945, knowing the political rights of citizens of the Moro-Moro and to know the
mechanism of removal of the right to vote in the General Election of Regional Head
(Election). The research method is by using a type of research and normative
juridical approach to the legislation (Statute Approach). The results showed that the
political rights under the Constitution of 1945 is non-derogable rights and derogable
rights. Political rights of citizens of the Moro-Moro is absolute and should not be
reduced compliance, among others, the right to equal treatment before the law, the
rights of citizenship status, the right to housing in the country, right to political
asylum and freedom from discrimination. While that may be deducted rights include
the right to freedom of peaceful assembly, right to freedom of association, right to
freedom of expression or through oral and written expression, and the right to elect
and be elected. The removal of voting rights of citizens can be justified by law.
