Abstract :
This research, which aims to describe the legal considerations given by judges in examining and deciding Case Number: 19/Pid.Sus/2024/PN.Yyk, uses doctrinal legal research methods that are analytically descriptive. The data analysed in this research is secondary data, in the form of Case Decision Number: 19/Pid.Sus/2024/PN.Yyk which was collected using the literature study method, the data that has been processed and analysed qualitatively based on deductive logic. Based on the results of the analysis conducted, it can be concluded that the judge in the verdict has considered the element of ?every person? and the element
of ?who produces or distributes Pharmaceutical Preparations and/or Medical Devices that do not meet the standards and/or requirements for safety, efficacy/benefit, and quality?. This is in accordance with Article 138 paragraph (2) and paragraph (3) of the Criminal Code, Jurisprudence Decision Number: 19/Pid.Sus/2024/PN, as well as doctrines from Pompe,Armand V Feigenbaum ,and Crosby which support the judge's belief in the decision.
