Abstract :
ENGLISH: The Blitar Religious Court has rejected the lawsuit filed against the plaintiff, that is Coordinator of PT. BFN against PT. BANK MS Blitar branch as the first defendant and PT. BANK MS Center as the second defendant with the verdict number 3333 / Pdt.G / 2014 / PA.BL. All such claims cannot be proven by the claimant with existing evidence and are not proven by law. This research has two problem formulations, that is: 1). How is the analysis of Blitar Religious Court's decision No. 3333 / Pdt.G / 2014 / PA.BL concerning hajj credit disputes on the perspective of Civil Code? 2). How is the analysis of the decision of the Blitar Religious Court Number 3333 / Pdt.G / 2014 / PA.BL about the KHES perspective hajj credit dispute? The purpose of this research is to know how the decision of Blitar Religious Court Number 3333 / Pdt.G / 2014 / PA.BL Hajj credit disputes perspective on Civil Code and KHES. This research is legal juridical normative research. The approach used is the approach of legislation and case approach. The types of data used are primary legal materials and secondary legal materials, by data collection method using library data and interview. Then in the data analysis is done through the examination stages of editing, verifying, classifying, analyzing, and concluding. The Decision of the Religious Court of Blitar Number of Cases 3333 / Pdt.G / 2014 / PA.BL is in conformity with Article 1320 and Article 1313 of the Civil Code relating to evidence in the form of witnesses and contractual agreements, the terms of the agreement between the plaintiff and the defendant. The decision of the Blitar Religious Court with the case number of Case 3333 / Pdt.G / 2014 / PA.BL has been in accordance with Article 26 and Article 29 of the Compilation of Sharia Economic Law concerning the legal requirements of an agreement.
