Abstract :
ABSTRAK Masyarakat Desa Tunglur Kecamatan Badas Kabupaten Kediri dalam hal pembagian harta warisan menggunakan cara lotre / undian, namun tidak semua harta warisan dibagi secara lotre, hanya barang-barang yang ada di dalam rumah yang di lotre seperti properti, elektronik, dan lain sebagainya. Desa Tunglur merupakan salah satu Desa yang masih melestarikan tradisi waris lotre. Jika melihat kondisi saat ini yang telah terjadi pada masyarakat Desa Tunglur khususnya dan masyarakat Kediri pada umumnya yang telah mengalami modernisasi dalam berbagai aspek kehidupan, seharusnya tradisi waris lotre yang telah dilaksanakan sejak dahulu sudah mulai hilang dan ditinggalkan. Akan tetapi kenyataan yang ada menunjukkan bahwa tradisi waris lotre masih ada, dan tetap dilaksanakan oleh masyarakat setempat. Hal ini menjadikan penulis tertarik untuk menela?ah lebih dalam tentang tradisi waris lotre tersebut. Penelitian ini tergolong penelitian kualitatif, jenis penelitian yang digunakan ialah penelitian studi kasus dengan menggunakan pendekatan fenomenologi, dan dianalisa dengan teori konstruksi sosial. Hasil penelitian ini menyimpulkan bahwa, terbentuknya pembagian waris dengan lotre di masyarakat muslim Desa Tunglur Kec. Badas kab. Kediri adalah dengan beberapa tahapan, tahapan yang pertama disebut dengan momen eksternalisasi, prosesnya ialah adaptasi diri dengan dunia sosio-kultural yang menghasilkan fenomena berupa penyesuaian diri dengan tradisi waris lotre, bahwasanya tradisi tersebut memiliki basis historis dan dasar normatifnya, tahap yang kedua disebut dengan momen objektivasi, prosesnya Interaksi diri dengan dunia sosio-kultural yang menghasilkan fenomena berupa penyadaran dan keyakinan, bahwa waris lotre merupakan tradisi yang positif bagi terciptanya kerukunan keluarga, tahap yang terakhir adalah momen internalisasi, prosesnya identifikasi diri dengan dunia sosio-kultural dan menghasilkan momen tentang adanya penggolongan sosial berbasis historis, kemudian melahirkan kelompok yang menggunakan dan melestarikan tradisi waris lotre. Adapun Alasan masyarakat muslim Desa Tunglur Kec. Badas Kab. Kediri memenuhi dan memelihara tradisi tersebut disamping ingin melestarikan tradisi nenek moyang adalah karena ingin terhindar dari perselisihan dan perpecahan, bahkan pertengkaran akibat berebut harta, dan pembagian waris dengan lotre merupakan pembagian yang paling mudah, karena yang dibagi adalah barang-barang yang ada di dalam rumah yang memiliki nilai jual rendah. ABSTRACT Tunglur Village Community of Badas Sub-district of Kediri Regency in terms of division of inheritance using lottery method, but not all inheritance is divided by lottery, only the items inside the house are in the lottery such as property, electronics, and so forth. Tunglur Village is one of the villages that still preserve the tradition of lottery inheritance. If you look at the current conditions that have occurred in Tunglur Village community and Kediri people in general who have experienced modernization in various aspects of life, Should the tradition of inheritance lottery that has been carried out since the first has begun to disappear and abandoned. But the facts show that the lottery inheritance tradition still exists, and is still carried out by the local community. This makes the author interested to examine more deeply about the tradition of the lottery inheritance This research belongs to qualitative research, the type of research used is case study research using a phenomenology approach, and analyzed with the social construction theory. The results of this study concluded that, (1) the formation of inheritance with lottery in Muslim society of Tunglur Village of Badas Subdistrict of Kediri Regency is with several stages, the first stage is called with moment of externalization,the process of adaptation to the world is a socio-cultural phenomenon that results in the form of adjustments with the tradition of inheritance lottery, The tradition that has a historical basis and normative base, The second stage is called the moment of objectivation, The process of self interaction with the socio-cultural world that produce the phenomenon of awareness and confidence, That the lottery inheritance is a positive tradition for the creation of family harmony, The last stage is the moment of internalization, The process identifies itself with the socio-cultural world and produces a moment of historical social classification, Then gave birth to a group that uses and preserves the tradition of the lottery inheritance. (2) The reason the Muslim community Tunglur Village Badas District Kediri meet and maintain the tradition in addition to want to preserve the tradition of the ancestors is because they want to avoid disputes and divisions, Even arguments from fighting over for treasure, and the division of inheritance with the lottery is the easiest division, because that is shared is the items in the house that has a lower sale value
