ABSTRACT Evacuation or refugee is one of humans? problems that always occurs in every phase of their history, caused by war or political, religious, military causes and others. These could threaten humans? existence because of the dangers of war, murder and torture. Islamic Sharia, as well as positive and international law have been designed the principles and the noble values of the rights of refugees. Islamic Sharia has also offered solutions for refugee and evacuation matter according to humanitarian principles. International law has also created a set of principles governing the right of the rulers. The problems of the refugees seem important to be discussed because of the increasing numbers due to problems and armed conflicts in the Middle East. Hence, this shows the importance of the research discussing the principles and the role in solving the problem of refugees. This research aims to know the problems faced by the Muslim refugees in Arab and Europe; determine the role of the principles governing the rights of the refugees under international law to solve the problem of the refugees; and find out the solutions offered by Islam for the refugees in accordance with Islamic Shari'a principles. This research uses inductive and comparative analysis method by applying documentation method for data and information collection obtained from an official legal library and Arabic language studies. The researcher chose this method after considering the importance of the research theme and the importance for referring to the Islamic Shari'a sources and books on positive law. The researcher also chose descriptive method that refers more to the description and analysis. This research concludes that Islamic Shari'a principles are the best solution in solving the problems of the refugees compared to the principles governing the rights of refugees under international law in the context of the universality of Islamic Shari'a in overcoming all the problems associated with the refugees. Among them are the responsibility to accept the refugees and the objection to refuse their presence, the obligation of providing a shelter for anyone that needs to be helped, those who are wronged or those who are tortured. Likewise, it is a must to accept the refugees for religious reasons by keep respecting the rulers in the countries providing individual refugees. ABSTRAK Pengungsian termasuk masalah-masalah yang selalu menimpa manusia pada setiap fase perjalanan sejarahnya, akibat dari peperangan atau sebab politis, religious, militer dan lainnya, dimana hal ini bisa mengancam keberlangsungan hidup manusia karena bahaya perang, pembunuhan dan penyiksaan. Syariat Islam telah merancang prinsip-prinsip dan nilai-nilai luhur terhadap hak-hak pengungsi, demikian juga hukum-hukum positif dan hukum internasional. Syariat islam juga telah menawarkan solusi bagi masalah pengungsi dan pengungsian dalam prinsip-prinsip kemanusiaan. Hukum internasional juga telah membuat sekumpulan prinsip-prinsip yang mengatur hak penguasa. Melihat kegentingan masalah para pengungsi, dengan jumlah mereka semakin meningkat akibat problem dan konflik bersenjata di kawasan Timur Tengah. Di sinilah pentingnya penelitian ini yang membahas tentang prinsip-prinsip dan perannya dalam mengatasi masalah para pengungsi. Tujuan penelitian ini adalah mengetahui masalah-masalah yang di
