ABSTRACT Traditions and cultures are the heritage of ancestors since years ago which contained of values as belief by society. In doing so, marriage tradition of Banjar has varied of traditions and cultures, one of them is Maantar Jujuran tradition. This kind of custom is defined when men give an amount of money and goods to women, this particular giving must incorporated under approval of discussion between both parties, however it was commonly occurred the failure of marriage because of refusal decision as inability to approve women?s request. This research aim to investigate broadly about Maantar Jujuran in marriage culture of Banjar in the village of Keramat Hulu Sungai. The theory used in this research is social construction of Peter L. Berger and Thomas Luckmann, the objectives are; (1) What is the background of society in term of Maantar Jujuran tradition. (2) What is the objective of society when implementing the tradition of Maantar Jujuran. This research is classified juridical-empirical and sociological approaches. The data collection was done by observation, interview and documentation. Technical analysis of the data by reduction or identifying an essential data, and then presenting the data and analysed by the theory of social construction and the last verification and given the conclusion. The results of this research are: firstly, the reason of society to follow tradition is an understanding of dowry verse in Al Quran and hadits, the status of the tradition of jujuran in Islam, if it is mentioned when the full marriage contract, that?s a part the dowry, and if it is mentioned only in part, that?s a part the gift. On the other hand based of historical facts from Prophet Muhammad Saw, that vary of dowry amounts existed since long times ago, besides the values contained in this tradition and their awareness to preserve this tradition, therefore this tradition has become law for them, this case is supported by islamic legal maxim of ?al-??dat muhakkamah?. Secondly, the purpose of society when using this tradition is, socio-economic factor in order to get equality social status among society. The philosophical factor is also involved in the belief of values of this tradition such as respecting women, honoring marriage, and cultivate between two families.
