ABSTRACT Decision of Judicial Review of the Constitutional Court of number of 69 / PUU-XIII / 2015 which contained about the meaning allowance of marriage agreement on article 29 of the Marriage Law of number of year of 1974 was a legal reform especially in the Islamic family law. The Constitutional Court as the organizing institution certainly has the authority in testing unconstitutional law with UUD 1945. The purposes of the research are to analyze and formulate the objectives and the purposes of Maqashid al-Shari 'ah review according to Jasser Auda, progressive law and legal certainty toward the decision of Judicial Review of the Constitutional Court of number of 69 / PUU-XIII / 2015 of the marriage agreement allowance during the mixed marriage bond. The formulation of the problems are: (1) the law implications of judicial review of the Constitutional Court of number of 69 / PUU-XIII / 2015 against the Marriage Agreement according to the perspective Maq??id al-shar??ah of Jasser Auda. (2) the analysis of judicial review of the Constitutional Court of number of 69 / PUU-XIII / 2015 against the meaning allowance of the marriage agreement according to the perspective Maq??id al-shar??ah of Jasser Auda. The type of research is normative legal research using a statue approach. The law materials are the primary legal material, namely the decision of the Constitutional Court and the secondary law material is supporting literacy source. After collecting the law materials, it will be analyzed with a qualitative analysis that provides word descriptions toward research findings. The research results were, the first, an analysis of the law implications of judicial review of the Constitutional Court of number of 69 / PUU-XIII / 2015 according to the perspective Maq??id al-shar??ah of Jasser Auda , namely (1) the law implications of constitutional rights guarantee against mixed marriage agreement after the Constitutional Court's decision of Maqashid al-Shari 'ah perspective for Jasser Auda, namely the realization of constitutional rights guaranteed that has been set in Article of 29 paragraphs of (1), (3), and (4) of 1/1974 about marriage law and it had been updated, the Constitutional Court has renewed a positive law about marriage, especially the relaxation of marriage agreements in Indonesia. (2) The law implications of the protection of common property after the Constitutional Court's decision of perspective of Maq??id al-shari?ah of Jasser Auda. The purposes of Maqa?id are the value of empowering of society?s needs legally, and as a legal reform that stands from an assumption that law is an institution that is aimed at bringing people to a justice, prosperous and happy lif
