ABSTRACT Inheritance law in Indonesia has undergone many progresses, one of them is the right inheritance of orphaned grandchildren from his grandfather's properties. In Indonesia that is explained in the Compilation of Islamic Law Article 185 of the substitute heirs, a child replace the parents become heirs because the main heirs of testator has died first. In fact in the first inheritance law there is no term change of position, but heirs who still have family ties are entitled to was}iat w?jibah. Therefore Thus the problem was formulated as follows, 1) How is the concept of inheritance grandchildren orphaned in the Compilation of Islamic law and jurisprudence? 2) How can distributive justice orphaned grandchildren inheritance in the Compilation of Islamic Law? To make clear the answer issues above researcher use this type of library research using conceptual and philosophical approach. Collecting data through documentary techniques with by researching library materials or documents called secondary data, in the form of legal materials primary and secondary. It can be conclude from the research. First the right of inheritance grandchildren orphaned to the assets of his grandfather in the Compilation of Islamic Law are described by substitute heirs. In the Sunni inheritance, there is no discussion about substitute heirs. Those relatives of their grandfather (nasabiyah) has the right to get testament according to Ibn Hazm. In this case, a grandfather must give testament his grandchildren not more than a third devision. Systems of substitute heirs occur if the origin heir has passed away before their substitute heir, then the subtitute heir have the right to replate their father positition to inherit the grandfather?s properties. Second, the justice in heritance based on distributive justice. The division of properties are distributed as big as service and obligation which carry out. According to Syafi?iyah and Zahiri Syafi'iyah and Zahiri there are similarities that grandchildren are not entitled to inherit from his grandfather. However, due to the bloodship of grandchildren, he is entitled to receive testament. This differs from the formula in Islamic Law Compilation about substitute heirs. Formulation of substitute heirs is not based on the opinion of both Zahiri scholars and syafi'iyah. But by Hazarin?s thought to change the understanding of the verses of inheritance without distinction between men and women heirs ABSTRAK Hukum waris telah mengalami banyak perkembangan, salah satunya mengenai kewarisan cucu yatim atas kakeknya. Hal tersebut dijelaskan dalam Kompilasi Hukum Islam pasal 185 tentang ahli waris pengganti. Seorang anak menggantikan orang tuanya menjadi ahli waris karena ahli waris utama meninggal terlebih dahulu dari pewaris. Nyatanya dalam fikih kewarisan sunni tidak ada istilah pergantian kedudukan, melainkan ahli waris yang masih mempunyai hubungan kekerabatan berhak atasnya was}iat w?jibah.
