ABSTRACT Protection of women workers in Act No. 13 of 2003 On labor on article 82 paragraph 1 only gives permission on leave against pregnant women workers about 1.5 month before giving birth. Islam teaches to protect one's soul, even the Messenger of delaying the penalty for women who committed adultery because he was pregnant. Therefore in this study will be discussed about how the understanding of article 82 of law No. 13 of 2003 on Labor in protecting the rights of the fetus, as well as how the analysis of article 82 of law No. 13 Year 2003 towards fulfillment of the rights of a fetus whose mother worked as labourers in factories in the perspective of Islamic law. This type of research is normative research, legal research by reviewing against secondary data. This Normative research including in library research, by studying books and books of fiqh. The approach used in this study was a conceptual approach. The data collection method used is by collecting secondary data from the primary legal materials, legal materials and legal materials tertiary secondary. Processing of data is carried out by several stages: editing, classifying, verifying, analyzing and concluding. The results of this research is that granting leave of absence, in article 82 only limited in protecting the rights of women workers who are pregnant, and not enough to meet the needs of Fetal rights it contains. So did in the study found that in the perspective of Islamic law maintenance of soul as well as the needs of the fetus must be more prominent than on the need to work. As the Messenger of delaying the sentence against a woman who committed adultery in order to protect the fetus contains. ABSTRAK Perlindungan terhadap pekerja perempuan dalam Undang-Undang No. 13 tahun 2003 Tentang ketenagakerjaan pada pasal 82 ayat 1 hanya memberikan izin cuti terhadap pekerja permpuan yang hamil sekitar 1,5 bulan sebelum melahirkan. Sehingga mereka tetap harus bekerja sekitar 7-8 jam selama 7,5 bulan dari awal masa kehamilan seperti bekerja di luar masa hamil. Meskipin demikian, pada hakekatnya perempaun yang hamil tidak boleh melakukan aktifitas yang berat dan aktifitas yang membuatnya lelah,karena itu akan membahayakan terhadap janin yang dikandungnya. Islam mengajarkan untuk melindungi jiwa seseorang, bahkan Rasulullah menunda hukuman bagi perempuan yang berzina disebabkan dia sedang hamil. Oleh karena itu dalam penelitian ini membahas bagaimana pemahaman terhadap pasal 82 Undang-Undang No. 13 Tahun 2003 tentang Ketenagakerjaan dalam melindungi hak janin, serta bagaimana analisis pasal 82 Undang-Undang No. 13 Tahun 2003 tentang pemenuhan hak janin yang ibunya bekerja sebagai buruh di pabrik dalam perspektif Al-Maqashid As-Syari?ah. Jenis penelitian ini adalah penelitian hukum normatif, dengan menelaah terhadap data-data sekunder. Penelitian Normatif ini termasuk dalam penelitian kepustakaan, dengan menelaah buku-buku serta kitab-kitab fiqh. Pendekatan yang digunakan dalam penelitian ini adalah pendekatan konseptual. Metode pengumpulan data yang dipakai ialah dengan mengumpulkan data sekunder dari bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier.
