ABSTRACT Islam Inheritance is a rule which regulate the transfer of property from someone who dies to the heir, this is different from the customs inheritance that the rules governing the process of wealth material or immaterial from derivatives to derivatives or from generation to generation, systems division of Islam inheritance and customary inheritance when use is considered valid. The purpose of writing of the thesis was to determine the inheritance practices in Muslim families as well as to determine the division of inheritance customs Kusambe village who uses both these law or one of them. In this study there are two formulations of problem, including: (1) How does the division of inheritance practices in Muslim families in indigenous communities Bali, especially in Kusambe Village, Dawan sub district, Klungkung Bali. (2) How does the influence of Islamic law on the division of inheritance practices in indigenous communities Bali, especially in Kusambe Village, Dawan sub district, Klungkung Bali, Perspective Compilation of Islamic Law. The method used in this paper is a type of research is empirical legal research and also uses a qualitative approach, is a qualitative approach is the research procedures that produce data descriptive form of words written or spoken of people and observed behavior, data collected should be the primary data. The data is based on interviews directly to the informant and secondary data is data of books related to the issue of this thesis. In this study, the result is the practice of the division of an estate in a Muslim family in the village Kusambe many using customary laws, provided that men get more parts taken from the women as well, and women only got half a part of it. Although there is also a heritage of Islamic law, customary strength used makes it difficult to apply the Islamic heritage in all communities Kusambe, Dawan sub district, Klungkung Bali. But the number of people studying at Islamic boarding bit much influences the inheritance system, so that Muslim families are already using the Islamic inheritance ABSTRAK Waris islam merupakan sebuah aturan yang mana mengatur pengalihan harta dari seseorang yang meninggal dunia kepada ahli warisnya, berbeda dengan waris adat peraturan yang mengatur proses kekayaan materiil atau immaterial dari turunan ke turunannya atau dari generasi ke generasi, sistem pembagian waris islam dan adat ketika digunakan dianggap sah, adapun tujuan penulisan dari skripsi adalah untuk mengetahui praktek pembagian warisan dalam keluarga muslim serta untuk mengetahui pembagian waris adat desa Kusambe yang menggunakan kedua hukum ini atau salah satunya saja. Dalam penelitian ini terdapat beberapa rumusan masalah, diataranya adalah: (1) Bagaimana praktek pembagian waris pada keluarga muslim di masyarakat adat Bali di Desa Kusambe, Kecamatan Dawan Klungkung Bali. (2) Bagaimana pengaruh Hukum Islam terhadap praktek pembagian waris di masyarakat adat Bali di Desa Kusambe, Kecamatan Dawan Klungkung Bali, Perspektif KHI. Metode penelitian yang digunakan dalam skripsi ini adalah jenis penelitian yang digunakan adalah penelitian hukum empiris dan juga menggunakan pendekatan kualitatif, yang dimaksud dengan pendekatan kualitatif adalah prsedur peneitian yang menghasilkan data deskriftif berupa kata-kata tertulis atau lisan dari orang-orang dan perilaku yang diamati, data yang dikumpulkan harus data primer.
