ABSTRACT The development of technology today is kicking off in a massive manner from the hardware department such as computer and hand phone. Both hardware goes along with the so called internet, as the existence of internet network has developed today and has been used to browse the cyberspace. In which in the past internet was only used for military purposes; sending the informations of enemies? location from one computer to another. Apart from using internet subscription formally using some amount of quota, there is one more possible way to access the internet which is using bug. It exists in the operator that can be exploited as an opportunity gap to use the internet for free. The particular topic is worth to be discussed through criminal law in the article 362 about thievery, and the possibility of it as theft element. Including in maslahah mursalah or known as ?the action of human is allowed when it is good for all the mankind?. The following is the problem of the studies: 1) How is the performance of bug usage as the media of free internet if judged by KUHP (criminal code) article 362? And 2) How is the performance of bug usage as the media of free internet in the perspective of maslahah mursalah? This study is classified as normative research. This study is also categorized as library research, a research which explores the basic principle of law. The study uses conceptual approach and qualitative descriptive methods. This method helps the writer to reveal facts, conditions, phenomena and variables exist in the process of the research and present it as it is. The results of this study indicate that when seen from Article 362 KUHP . The elements that must be fullfied the theft that is taking an item, property of others or in part, with the goal of having its own, in a way against the law. With the elements above, the practice of using bugs as free internet facilities do not meet all of the above elements. However, such actions hurt justisce society. And when assessed according to the Islamic law that is about maslahah is included into maslahah al-Mulghah due to get it in a way that vanity use the faults of others to get the treasure. ABSTRAK Perkembangan teknologi yang sekarang sedang terjadi secara global, mulai dari perangkat keras seperti kompute. perangkat keras tersebut tidak lepas dengan namanya jaringan atau yang biasa disebut dengan jaringan internet. Dengan adanya jaringan internet yang sudah sangat maju pada zaman sekarang selain digunakan untuk berselancar di dunia maya, yang pada zaman dahulu internet hanya digunakan untuk keperluan militer untuk mengirim informasi-informasi tentang keberadaan musuh ke komputer satu kepada komputer yang lain. Selain dengan berlangganan Internet dengan menggunakan Kuota terdapat satu cara untuk dapat mengakses internet yaitu dengan cara menggunakan bug yang terdapat pada operator sehingga dapat digunakan sebagai celah untuk mendapatkan internet secara gratis. Hal tersebut layak dikaji melalui hukum pidana yang terdapat pada pasal 362 tentang pencurian serta apakah memenuhi unsur-unsur pencurian.Selain itu dilihat dari sudut pandang maslahah Dalam penelitian ini terdapat rumusan masalah sebagai berikut:
