ABSTRACT A law and a thought constantly evolves with the times and places. A thought arises because of a new problem and no law provides an answer to what is happening. Some of the prominent figures in a particular field are eager to answer a case in which one of them is DR.K.H. Didin Hafiduddin, M.sc. With the background of zakat in modern economy, Didin Hafiduddin explained that real sector zakat like orchid plants must be issued zakat and enter into agricultural zakat and must be issued at harvest time. Agriculture in question is rice or wheat. We know orchids are ornamental plants, and only certain circles who need them. In contrast to rice or wheat which is a staple crop that every individual needs for the primary needs and can be directly utilized by the community. This study is focused on the background and the law istinbath used by Didin Hafiduddin in the zakat of orchid plant business. In addition, the purpose is To add a broader insight about the implementation of the payment of zakat profession carried by the society. Seeing the development of the era of many professions that are considered new and there is no sharia that govern directly, especially those in the country of Indonesia. This study includes normative research because it does not need field research to answer the problem formulation. The approach used is a conceptual approach with an analytical descriptive approach. Primary legal material, data obtained from the writings of Didin Hafiduddin. Secondary law material, obtained from other books that discuss about zakat, as well as journals or writings related to the title of this study. Methods of data collection, using Documentation method, obtained from materials such as documents, such as books, journals, articles etc. Can be concluded, the background of Didin Hafiduddin in zakat orchid plant business is the essence of Allah's property, so that later useful property is useful and is a potential business. Therefore the results of the orchid plant business must be issued, considering Zakat is one of the pillars of Islam that must be done if it exceeds a certain level. While the legal istibath used is qiyas, by equating the zakat count of orchid plants with agriculture issued every time the harvest with a count of 5% in the expenditure of Zakat on the harvest. after deducting the necessities and expenses of the business and watering the orchid plant itself. ABSTRAK Sebuah hukum dan pemikiran senantiasa berkembang sesuai dengan zaman dan tempat. Suatu pemikiran muncul karena adanya permasalahan yang baru dan belum ada hukum yang memberikan jawaban akan hal yang sedang terjadi. Beberapa tokoh yang ahli dalam sebuah bidang tertentu berijtihad untuk menjawab sebuah kasus yang terjadi salah satunya adalah DR.K.H. Didin Hafiduddin, M.sc. Dengan dilatar belakangi oleh zakat dalam perekonomian modern, Didin Hafiduddin menjelaskan bahwa zakat sektor riil seperti tanaman anggrek wajib dikeluarkan zakat dan masuk kedalam zakat pertanian dan wajib dikeluarkan pada saat panen. Pertanian yang dimaksud adalah padi atau gandum. Kita ketahui tanaman anggrek adalah tanaman hias, dan hanya beberapa kalangan tertentu yang membutuhkannya.
