Abstract :
Penulis melakukan penelitian ini dilatar belakangi oleh kurangnya kepedulian masyarakat umum terhadap masa pemilihan umum serta kurangnya pemahaman mengenai apa saja tindak pidana pemilu yang kerap kali terjadi juga tahapan dalam menyelesaikannya. Tujuan dibutanya penelitian ini adalah untuk menjelaskan jenis tindak pidana pemilu yang sering terjadi dan mengetahui alur penyelesaian tindak pidana terhadap tindak pidana pemilu. Metode penelitian yang digunakan penulis yakni yuridis normative yang data kajiannya berupa dokumen. Karenanya data yang digunakan dalam penelitian ini adalah data sekunder yakni dokumen yang berhubungan dengan masalah yang diteliti spereti peraturan perundangan dan jurnal hukum terkait bahasan. Selain studi kepustakaan yang digunakan sebagai metode pengumpulan data, penulis juga melakukan wawancara dengan pihak Bawaslu kota semarang agar data yang didapatkan lebih kuat dan akurat. Dari hasil penelitian dan Analisa penulis disimpulkan bahwa: 1) jenis tindak pidana yang sering terjadi dalam pemilu adalah kampanye menggunakan fasilitas negara, kampanye di tempat ibadah, penghilangan hak suara, serta money politik, dan 2) alur penyelesaian dilaksanaan sesuai acara yang berlaku namun didapatkan data tidak ada kasus tindak pidana pemilu di kota semarang yang diteruskan ke pengadilan, melainkan terhenti pada pembahasan I dan II Gakkumdu. ABSTRACT The author of this research made the article because of the background of the society?s careless to the era of political election and the lack of understanding about election crimes that oftenly happened and the steps of solving problem in these cases. The aim of the author writing this study is exactly to explain kinds of election crimes commonly happened that have never been realized by people and to find out of the fixing problems by the steps written on the legal rules. This study is a normative - juridical research which having documents as the materials. Because of this condition, the research uses secondary datas such as documents that having relation of the matched cases as what have been researched as legal journal, laws and the regulations. In the other hand of literature studies used by the author as the materials, interview with the sources of Bawaslu Semarang also has been done in order getting an acuratest fact and strongest data of the issue. According to the result and analysis of this research, it concluded that: 1) the types of criminal offences that oftenly happened are campaign uses the state facilities, campaign in the place of worships and public places, deliberate removal of the voting rights, and the most severe is money politics and 2) the completion flow must be done by the legal regulation has stated. But the analysis and the data showed there were no election crime forwarded to the court in the state of Semarang unless stopped by the first and second discussion of Gakkumdu.
