Abstract :
Kehilangan dana nasabah merupakan suatu permasalahan yang masih sering terjadi di dunia perbankan dan menjadi hal yang mengecewakan bagi nasabah, sehingga banyak nasabah yang mengalami kerugian. Seharusnya pihak bank harus lebih berhati-hati lagi dan tidak lalai dalam melindungi dana nasabah dan memberikan pengaawasan yang lebih ketat dalam melindungi data nasabah. Penelitian ini merupakan penelitian yuridis normatif dengan pendekatan undang-undang atau statue approach. Jenis data yang digunakan dalam skripsi ini adalah data sekunder yang terdiri dari bahan hukum primer, bahan hukum sekunder, bahan hukum tersier serta menggunakan teknik pengumpulan data, teknik pengolahan data dan metode analisis data. Dalam hal terjadinya perselisihan antara bank dan nasabah atas hilangnya dana nasabah, untuk menyelesaikannya maka baik bank maupun nasabah harus mengedepankan musyawarah. Jika hilangnya dana nasabah, maka harus dilakukan sesuai dengan ketentuan peraturan perundang-undangan. Kata Kunci : Bank, Nasabah. / Loss of customer funds is a problem that still often occurs in the banking world and is a disappointing specter for customers. So that the bank does not work as it should so that it can be said that the bank does not really apply the principle of prudence and supervision in protecting customer data because it does not meet the principles that have been determined by the bank. Banks should be more careful and not negligent in protecting customer data and provide stricter supervision in protecting customer data. The loss of customer funds can cause losses to the bank and the customer so that it can lead to a legal event, one of which is bad credit, such as the case of decision no: 106/Pdt.G/2018/PN Bpp The research methodology used by the author is normative juridical which is descriptive in nature, to find out how the responsibility of the bank due to loss of customer funds causes losses to customers. In the event of a dispute between the bank and the customer over the loss of customer funds, to resolve it, both the bank and the customer must prioritize deliberation. If the customer's funds are lost, it must be done in accordance with the provisions of the legislation. Keywords : Bank, Costumer
