Abstract :
Pada hakikatnya, tujuan hukum perlindungan konsumen adalah memberikan perlindungan kepada konsumen Indonesia. Pemberlakuan regulasi terkait e-commerce menunjukkan perhatian dan keseriusan pemerintah dalam mengatur perlindungan konsumen di Indonesia. Akan tetapi, masih banyak kasus terkait transaksi e-commerce dimana masih belum optimal penyelesaiannya serta cenderung mengabaikan hak konsumen. Penelitian ini mengkaji perlindungan hukum terhadap konsumen pada salah satu e-commerce sekaligus platform yang digunakan masyarakat Indonesia dalam berbelanja virtual yaitu Mall To Go (www.malltogo.id). Rumusan masalah: 1.) Bagaimana pengaturan e-commerce platform Malltogo.id dalam kaitannya dengan perlindungan konsumen? 2.) Bagaimana upaya perlindungan hukum terhadap konsumen e-commerce platform Mall To Go. Metode Penelitian menggunakan jenis metode penelitian hukum yuridis normatif dengan cara meneliti bahan primer yang disertai wawancara serta bahan sekunder. Kerangka teori yang digunakan teori perlindungan hukum, teori keadilan, serta teori ekonomi analysis of law. Ketentuan Undang-Undang Perlindungan Konsumen tidak hanya melindungi sisi konsumen, tetapi juga mendorong terciptanya iklim usaha yang sehat dan mendorong munculnya pelaku usaha yang tanggung dalam menghadapi persaingan yang ada. Namun, pada penerapan e-commerce platform Mall To Go perlu meningkatkan kualitas dan kebijakan dalam memenuhi pasal-pasal hak konsumen agar bisa sesuai dengan UU No. 8 Tahun 1999. Revisi Undang-Undang Perlindungan Konsumen (UUPK) perlu dilakukan agar relevan dengan perkembangan perdagangan offline dan e-commerce serta aspek untuk melindungi konsumen.

ABSTRACT
Consumer protection law aims to provide protection to consumers in
Indonesia. The enactment of regulations related to E-Commerce indicates
the government's attention and seriousness in regulating consumer
protection regulations in Indonesia. However, there are still many cases
related to e-commerce transactions whose settlements are not optimal and
tend to ignore consumer rights. This study examines the legal protection of
consumers on one of the e-commerce platforms as well as the platform used
by Indonesian people in virtual shopping, namely, Mall To Go
(www.malltogo.id). Problem formulation: 1.) How is the Malltogo.id e-
commerce platform set up concerning consumer protection? 2.) What are
the legal protections for e-commerce consumers on the Mall To Go
platform? The research method uses a normative juridical legal research
method by examining primary materials accompanied by interviews and
secondary legal resources. The theoretical framework used is the theory of
legal protection, the theory of justice, and the economic theory of analysis
of law. The provisions of the Consumer Protection Act not only protect the
consumer side but also encourage a healthy business climate and encourage
the birth of strong business actors in the face of existing competition.
However, in the implementation of the Mall To Go e-commerce platform, it
is necessary to improve quality and policies in fulfilling consumer rights
articles to comply with Law no. 8 of 1999. It is necessary to revise the
Consumer Protection Law (UUPK) so that it is relevant to the development
of offline trade and e-commerce as well as aspects to protect consumers.
