Abstract :
Korupsi telah menjadi budaya di seluruh bidang pemerintahan di Indonesia. Kenyataan ini membuat Indonesia menduduki posisi teratas kasus korupsi di wilayah Asia Tenggara. Salah satu bidang yang dianggap rawan korupsi adalah pengadaan barang dan jasa. Proses penyidikan tindak pidana korupsi oleh Penyidik Polri terkait dengan Pengadaan barang dan jasa tidak semudah dari penyidikan bisa, hal ini dikarenakan Kejaksaan juga melakukan proses penyidikan sekaligus proses penuntutan, tentunya proses penyidikan tindak pidana korupsi yang dilakukan oleh Penyidik Polri sesuai sistem peradilan pidana berkas perkara harus melalui Kejaksaan, salah satu hambatannya adalah dalam proses kordinasi dimana Kejaksaan lebih mengutamakan perkara korupsi yang ditangani sendiri. Adapun hambatan lainnya dalam unsur pembuktian tindak pidana korupsi yang terkait dengan kerugian keuangan negara, harus adanya perhitungan kerugian negara, dalam perkara korupsi pengadaan barang dan jasa di Sudin PU kota Jakarta Timur sebagaimana putusan vonis hakim pada perkara tindak pidana korupsi Nomor 63/Pidana Khusus/TPK/2017/PN-JAKPUS, dimana peran penting dalam menentukan perhitungan kerugian negara adalah Badan Pemeriksa Keuangan (BPK) atau Badan Pengawasan Keuangan dan Pembangunan (BPKP), mengingat tidak sebandingnya jumlah auditor dengan jumlah perkara dalam penghitungan kerugian keuangan negara diperlukan waktu yang cukup lama, dimana melebihi ketentuan batasan waktu dalam mata anggaran penyidikan korupsi oleh Polri, sehingga adanya tidak keseimbangan antara biaya penyidikan yang dikeluarkan negara dengan putusan atau vonis Pengadilan terhadap terdakwa pidana korupsi tersebut, maka dari awal proses penyidikan mulai muncul berbagai intervensi baik dari internal maupun dari eksternal yang menginginkan perkara tindak korupsi tersebut dihentikan, Oleh karena itu Penyidik Polri dalam penanganan tindak pidana korupsi dituntut memiliki integritas yang tinggi dalam melakukan penegakan hukum terkait tindak pidana korupsi./ Corruption has become a culture in all areas of government in Indonesia. This fact makes Indonesia occupy the top position in corruption cases in the Southeast Asian region. One area that is considered prone to corruption is the procurement of goods and services. The aims of this study is to classify the obstacles found by Police investigators and to detail the process that Police investigators went through until the publication of P21 by the public prosecutor until it was decided by the Central Jakarta District Court with the decision Number 63/Special Crime/TPK/2017/PN.JAK -PUSSY. The method used in this study is a normative method because the instruments used are document studies (court decisions) and interviews. The results of the study indicate that the obstacles received by investigators in the process of investigation, investigation to the judge's verdict on the corruption case Number 63/Special Crime/TPK/2017/PN-JAKPUS are 1) the length of time in the process of calculating state losses by BPKP, because there are only 2 institutions that can determine state losses, namely BPK and BPKP as well as the limited number of auditors while many cases of corruption cases from other law enforcement officials that must be calculated state losses; (2) Communication with the party with the Public Prosecutor (JPU) who was cut off in order to equal perception in handling corruption cases so that the case file did not go back and forth/P19 which took a long time to complete the case file documents until it was declared complete/P21. Attention and Connection Factors In this case, investigators have received various interventions from the connection known by the parties involved and in essence requested that the case be assisted and stopped the process. Furthermore, the process of investigation and investigation carried out by Police investigators in the corruption case Number 63/Special Crime/TPK/2017/PN-JAKPUS are 1) Investigators obtain information related to corruption cases at the East Jakarta Public Works Sub-Department. The information is in the form of a fictitious contract in the procurement of hot-mix and asphalt emulsion goods/materials; (2) The investigator issues an investigation warrant and invites clarification to the Head of the East Jakarta City Public Works Sub-Department to conduct interviews with related parties and conduct document analysis as well as observations and checks to locations that are objects of work at the East Jakarta City Public Works Sub-Department; (3) Investigators make summons to witnesses, search and confiscate evidence; (4) Investigators coordinate with BPKP to calculate losses on State Finances.
