Abstract :
The purpose of this research was to have a
Better insight of the Collective Labor Agreement as a tool of law protection.
Accordance to that purpose this research analysed legal principles and concepts of contract
of employment as the bases of employment relationship, and Collective Labor Agreement concepts.
This research was based on the Legal Theory. Legal Theory analysed leqal aspects, as a theoretical concept or its practical apply in an interdisiplinair perspective, to
get a better comprehension and explanation of the legal materials.
By using explanation research method several legal aspects of Contract of Employment and Collective Labor Agreement were explained.
Contracts of Employment could be classified as, contracts thatt are not based on a Collective Labor Agreement and contr-acts basEd on a Collective Labor Agreement.
The first type of contract are not able to ensure law protection to the employees to get their normative rights.
Collective Labor Aqreement js the source of law to the Contract of Employment. An employer and members of a labor union which are parties to a Collective Labor Agreement are bound by the agreement. Provisions in a contract of employment contrary to the Collective Labor Agreement is void. Collective Labor Agreement as a source of law gives law protection to the employer and employee. It could create stability in the employment relationship, so that an employee and an employer could fulfill their interests.
