Abstract :
The thesis entitled "The Role of Notary in the Formation of Deed of Bond Sale and Purchase Creation Between Consumers and Developers of Basilica Apartment In Palembang City" examines the legal issues concerning what the legal consequences of the cancellation of the Sale and Purchase Agreement between the Basilica Apartments and the consumer, how to protect the law against the consumer due to the cancellation of Basilica Apartment Sale and Purchase Agreement and how the Notary's role on cancellation of Basilica Bond Agreement. Type of research conducted using the study normatively, with the approach legislation, cases and analytical. The research data used is secondary data in the form of primary law material namely Book of Civil Law (Civil Code), Law Number 20 Year 2011 about Flats, Law Number 8 Year 1999 and Law Number 2 Year 2014 about Changes of Law Number 30 Year 2004 concerning Notary Position. Secondary law materials are books, articles, reports and / or various scientific papers that discuss about the apartment, purchase binding agreement, and tertiary legal material is an Indonesian dictionary. The data is processed systematically and analyzed by using legal interpretation grammatically, historically, systematically, sociologically, authentically, interdisciplinary, multidisciplinary, and inductive withdrawal. The result of the research and the conclusion obtained is the result of the law of cancellation of the Sale and Purchase Agreement between the Basilica Apartment and the consumer with the termination of legal relationship in the form of cash refund, but not followed by the payment of the fine, the protection of the consumer law against the cancellation of Basilica Apartment Bonding Agreement This is evident from the application of Kepmenpera Number 11 / KPTS / 1994 due to the absence of compensation in the form of penalties and the last of the Notary's role on the cancellation of the Bonding Agreement of Bonding and Sale Agreement is obliged to provide legal counseling to the constituents in accordance with Article 15 paragraph 2 (e) UUJN, the Notary is required to provide information related to legal facts to be contained in the Deed of Sale and Purchase Agreement.
