Abstract :
This study entitled Criminal Act False Land Ownership Document for the Issuance of Land Ownership Certificate (A Case Study At Palembang Land Office) aims at finding out the legal criteria used to prove the originality of land ownership document, the rsponsibility of the Land Office for the Land ownership Certificate with false land ownership document as decided by the court, and the regulations concerning land ownershiprights in the future. It was a normative legal study with statutory and case approaches. Based on the results of this study,the authors conclude that (1) the originality criteria of land ownership documents used for the issuance of land certificate can be determined by juridical verification of the Land Office, by Criminal Code material verification and by verification at court (2) the responsibility of the Land Office for Issued certificates with false ownership document as decided by the Court is only administrative;and (3) the improvement toward related regulations, such as land registration and criminal act, to prevent and resolve the creation and use of false ownership document is needed. Furthermore, it is recommended that government strengthen regulatory aspects to prevent counterfeiting of land rights both in preventive and repressive aspect. For preventive aspect, the Land authority must emphasize the principle of prudence, coordinate with related parties, provide legal educationto the public, and use hologram or barcode on certificate. For repressive aspect, the government should impose strict penalty to give a deterrent effect.
