Abstract :
Indonesia is a maritime country whose entire territory is surrounded by the
sea. Where no less than seventy percent is sea level. So do not be surprised when
the State of Indonesia has thousands of islands that lie throughout the
archipelago. Indonesia as an archipelagic country characterized by an
archipelago united by water and air areas with rights and sovereignty boundaries
established by law. So in this paper, several formulations of the problem are
determined, namely how is the legal protection for passengers in ferry
transportation in the Kalianget-Kangean area and how is the responsibility of the
shipping company for the safety of passengers and goods in the Kalianget-
Kangean area.
The research objective to be achieved is to describe the legal protection of
passengers in the transportation of ferry crossings in the Kalianget-Kangean area
and how the responsibility of the shipping company for the safety of passengers
and goods in the Kalianget-Kangean area is.
This study uses a normative juridical research method. To approach the
problem using a research approach to legislation and a conceptual approach. The
types of data or sources of legal materials used are Primary and Secondary Data
Types.
Legal protection is identical to the guarantee of rights and obligations in an
agreement between the two parties. Legal protection is used in an effort to protect
the interests of the parties in a legally valid agreement. The forms of legal
protection for sea transport passengers are divided into two, namely preventive
legal protection and repressive legal protection. The ship owner in fulfilling all
his obligations must be responsible for all things while traveling, both the safety
of passengers, the condition of the goods and so on. All of that is the
responsibility of the ship owner as the provider of transportation services.
Every consumer/passenger of ships using sea transportation must get full
legal protection, both regarding the safety of the passengers themselves and their
luggage. The ship owner must be able to be responsible for what is the
passenger's right, this responsibility can be in the form of compensation or
punishment.
